Time recording is compulsory

Following a decision of the European Court of Justice, employers are to be legally bound to record their employees’ work times.

The CJEU makes full time recording compulsory

The Court of Justice of the European Union (CJEU) in Luxembourg decided on the 14th of May 2019 that EU member states must oblige their employers to introduce full time recording in future. As the weekly journal “Die Zeit” reports, the recording of overtime only will no longer suffice. The verdict will strengthen the rights of employees in the CJEU’s opinion. An instrument for time recording would make it easier to prove infringement of rights. The German Working Hours Act so far only prescribes that overtime hours above and beyond the normal workday must be recorded. According to the CJEU it is now the duty of the EU member states to oblige the employers to introduce an “objective, reliable and accessible system” for work time recording.
